If you are considering putting your Unit on the market in the near future, pay close attention! Some owners move into an association without complete knowledge as to which documents govern an association. At The Legends, each owner is a member of both The Legends at Aberdeen Condominium Association, and the Aberdeen Master Association. While statutes and case law also control, each association has its own unique documents that are imposed or required for the protection and benefit of all owners. The governing documents at of each association are as follows:
1. Declaration: This document contains a legal description and “declares” the property as a community association. It is recorded with the county wherein the property is located and also recites the restrictions imposed for the betterment of the community.
2. By-laws: This document controls the internal governmental operation of the association itself. It too is recorded with the county and defines aspects such as owner voting rights, number and term of board members, and association procedures.
3. At Aberdeen, there is also a separate Declaration and Bylaws for the Master Association, The Golf Course, and a Tri Party Agreement, which includes the City of Highland Heights.
4. Rules & Regulations Handbook: While the declaration and by-laws are generally written by the developer’s attorney, the rules and regulations are generally promulgated by the board. This document, which is often in booklet form, contains plain English language that covers information and conduct regulations of the association and the community’s residents.
Original owners received a large white binder that included the Condominium and Master Association governing documents. Don’t lose this! With over 400 pages it is costly to reproduce. It is the seller’s responsibility to make sure the buyer has these documents. If you do need a copy, one can be obtained from Stevens Management for $75. Electronic transmission is at no cost to owners. A copy of the Rules and Regulation Handbook can also be obtained at no charge from the management company.
